If pvcstrip.com determines that a returned product is covered under this warranty, pvcstrip.com shall replace the same at no additional cost to customer. CUSTOMER ACKNOWLEDGES AND AGREES THAT ITS FAILURE TO FOLLOW THE WARRANTY CLAIM PROCEDURE SET FORTH ABOVE, INCLUDING THE PROCESS BY WHICH IT REPORTS ANY ALLEGED DEFECT IN MATERIALS OR WORKMANSHIP AND OBTAINS ITS RGA FROM PVCSTRIP.COM, SHALL CONSTITUTE A RELEASE AND WAIVER OF ALL WARRANTY OBLIGATIONS OF PVCSTRIP.COM HEREUNDER.
Warranty coverage does not include any defect or performance deficiency which is the direct or indirect result, in whole or in part, of accident, abuse, misuse, or other damage or alteration of the product by persons other than pvcstrip.com employees.
THIS WARRANTY SUPERSEDES ALL INCONSISTENT PROVISIONS OF ANY AND ALL PURCHASE ORDERS, INVOICES, ACKNOWLEDGMENTS, OR OTHER WRITINGS OR STATEMENTS, WRITTEN OR OTHERWISE. PVCSTRIP.COM DISCLAIMS ALL OTHER EXPRESS OR IMPLIED WARRANTIES AND PRODUCT LIABILITY, SPECIFICALLY INCLUDING THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
4. LIMITATION OF LIABILITY. Notwithstanding anything to the contrary, in no event will pvcstrip.com be liable for any indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory, including without limitation loss of data or its use, loss of profits, loss of business, or other economic damages, even if advised of the possibility of such loss or damage.
